Anime Sekai Policies
By registering for, purchasing a ticket to, or attending Anime Sekai (the "Event"), you, whether an attendee, participant, vendor, exhibitor, guest, or volunteer (collectively, "Participant" or "You"), acknowledge and agree to be bound by these policies. These terms, along with any other policies or instructions posted on the official Anime Sekai website, displayed at the Event venue, or communicated by authorized Anime Sekai representatives, apply to You at all times when You are present on or around the Event Venue (the Event location) and any Official Hotels (hotels designated by Anime Sekai) within the City (where the Event is held).
1. ASSUMPTION OF RISK, WAIVER, AND INDEMNIFICATION
BY ATTENDING OR PARTICIPATING IN THE EVENT, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:
A. VOLUNTARY PARTICIPATION & ASSUMPTION OF RISK: Your participation is entirely voluntary. You UNDERSTAND THAT ALL EVENT ACTIVITIES INVOLVE INHERENT RISKS AND DANGERS, including personal injury (even serious injury or death), illness (including contagious diseases), and property damage or loss. These risks can arise from your own actions, others' actions, or the condition of the Venue. AS A CONDITION OF PARTICIPATION, YOU VOLUNTARILY AND EXPRESSLY ASSUME ALL SUCH FORESEEABLE AND UNFORESEEABLE RISKS.
B. RELEASE AND WAIVER OF LIABILITY: In exchange for being allowed to participate, YOU, ON BEHALF OF YOURSELF, YOUR HEIRS, AND ALL OTHERS ACTING ON YOUR BEHALF, UNCONDITIONALLY WAIVE AND RELEASE Anime Sekai, its parent company, affiliates, the City, Venue, Official Hotels, and their respective officers, directors, employees, agents, contractors, volunteers, sponsors, and assigns (collectively, "Released Parties") from ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, AND LIABILITIES of every kind, known or unknown, arising from or related to Your Event participation. THIS RELEASE EXPRESSLY INCLUDES CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES and acts/omissions by third-party vendors (e.g., medical, food/drink).
C. INDEMNIFICATION AND HOLD HARMLESS: You further agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from all demands, damages, losses, and liabilities (including attorney's fees) incurred by them due to any claim asserted by You or any third party arising from or related to Your Event participation, Your breach of these policies, or Your acts/omissions, INCLUDING CLAIMS ALLEGING ORDINARY NEGLIGENCE BY THE RELEASED PARTIES.
D. ACKNOWLEDGMENT AND LIMITATIONS: You understand the Event activities and confirm you are qualified to participate. You will immediately stop participating if you believe conditions are unsafe. THIS WAIVER IS INTENDED TO BE INTERPRETED AS BROADLY AS PERMITTED UNDER TEXAS LAW. This Waiver DOES NOT APPLY to acts of gross negligence, willful misconduct, or intentional torts by any Released Party.
2. Medical Authorization
In case of injury, illness, or medical emergency during the Event, You authorize Anime Sekai staff, the Venue, and Official Hotels to seek and obtain necessary emergency medical services. You understand they are not obligated to do so, and You are solely responsible for any associated costs.
3. Property Damage
You understand that if You damage any real or personal property related to Your Event participation (including property of the Venue, Official Hotels, the City, or any other third party), You are solely and personally responsible for all repair, replacement, and incidental or consequential damages.
4. General Terms and Acknowledgments
A. GOVERNING LAW AND JURISDICTION: These policies are governed by Texas law. You consent to the exclusive jurisdiction of federal or state courts in Abilene, Texas, for any disputes.
B. SEVERABILITY: If any provision is unenforceable, it will be severed, and the remaining provisions will stay in effect.
C. BINDING EFFECT: These policies bind You, Anime Sekai, and our respective heirs, successors, and assigns.
D. ELECTRONIC AGREEMENT: Your electronic agreement constitutes a legally binding electronic signature, just like a hard copy.
E. ACKNOWLEDGMENT OF REVIEW AND RIGHTS WAIVED: YOU AFFIRM YOU AGREE TO THESE POLICIES VOLUNTARILY. YOU HAVE CAREFULLY READ AND FULLY UNDERSTOOD THIS ENTIRE DOCUMENT. BY ACCEPTING THESE POLICIES, YOU ARE GIVING UP CONSIDERABLE FUTURE LEGAL RIGHTS. Your acceptance proves Your intention to execute a complete and unconditional waiver and release of all liability to the fullest extent permitted by law. You are over 18 and mentally competent.
F. PARTICIPANT ACCOUNTABILITY: It is Your responsibility to read, understand, and adhere to all Event policies.
Disruptive Behavior Policy
Anime Sekai strives for a safe, family-friendly environment and has zero tolerance for disruptive, dangerous, or offensive behavior. Anime Sekai reserves the right, in its sole discretion, to take action, including warnings, immediate ejection from the Event without refund, revocation of credentials, or referral to law enforcement. Prohibited behaviors include fighting, heckling, impeding traffic, offensive conduct, public intoxication, or failing to follow staff directions. Anything illegal outside the convention is illegal inside.
Defamation and Public Conduct
Participants understand that defamation (libel/slander) is a serious offense. You must refrain from false, misleading, or disparaging statements about Anime Sekai, its parent company, staff, or the Event, across all communication platforms. Anime Sekai reserves all its legal rights and remedies to address any defamatory conduct.
Photography, Recording, and Promotional Material
A. BY PARTICIPANTS: You must obtain express permission before photographing or recording any vendor, artist, or individual, their booth, or merchandise.
B. USE OF LIKENESS BY ANIME SEKAI: By attending, You irrevocably grant Anime Sekai and its authorized representatives the perpetual, worldwide, royalty-free right and license to photograph, videotape, record, and use Your image, voice, and likeness for any legitimate purpose (e.g., promotional, marketing) without further compensation or notification. You waive any right to approve the finished product.
5. Parent or Legal Guardian’s Additional Release for Minors
IF THE PARTICIPANT IS UNDER 18, A PARENT OR LEGAL GUARDIAN MUST REVIEW AND AGREE TO THESE POLICIES FOR THE MINOR AND THEMSELVES.
As the parent/guardian, You affirm Your authority to agree on the Minor’s behalf. YOU UNDERSTAND AND AGREE THAT ALL FOREGOING TERMS, INCLUDING THE ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNIFICATION (SECTION 1), APPLY FULLY TO THE MINOR AND TO YOU. YOU FURTHER AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL CLAIMS brought by or on behalf of the Minor, or any third party, related to the Minor's Event participation, INCLUDING CLAIMS ALLEGING ORDINARY NEGLIGENCE. You are over 18 and mentally competent.
CHILDREN POLICY: All children under 13 must be accompanied by a parent or legal guardian at all times.
6. 18+ Content Policy
Anime Sekai strictly prohibits the sale or display of any 18+ content. Violators face immediate removal from the Event without refund and potential bans.
7. Code of Conduct and Weapons Policy
A. GENERAL CODE OF CONDUCT: All Participants must conduct themselves respectfully. Any disruptive, offensive, or unsafe behavior, in Anime Sekai's sole discretion, may result in immediate action, including removal without refund.
B. WEAPONS POLICY: Safety is paramount. NO LIVE STEEL IS PERMITTED. All weapons and costume props MUST BE INSPECTED AND APPROVED at the Peace Bonding station.
I. WEAPONS NOT PERMITTED: Includes, but is not limited to: Live Steel, any type of functional or non-functional guns/projectile launchers (except clearly marked toy props), "Paddles," Nunchaku, and Explosives/Chemicals. Anything illegal in Abilene/Texas is illegal at the convention.
II. WEAPONS PERMITTED (Subject to Approval): Includes staves, bo sticks, wooden swords (handled responsibly), and fake/prop weapons (non-dangerous materials, under 6'6" height, under 50 lbs, metal chains under 3').
III. BEHAVIOR WITH WEAPONS/PROPS & PEACE BONDING: Misuse of any prop will require its removal. Weapons purchased from vendors must be immediately boxed and removed to your vehicle. All props are subject to Anime Sekai staff inspection and approval (Peace Bonding) regardless of prior approval. No concealed weapons. Props may be zip-tied into sheaths. All Anime Sekai and Public Safety staff decisions are final.
8. Guest and Autograph Policy
NO GUARANTEE you will receive an autograph. Guests WILL NOT SIGN BOOTLEG ITEMS. Limits apply (generally ONE ITEM PER PERSON unless specified). Be prepared for signing and do not request excessive personalization. Anime Sekai staff reserves the right to refuse service for non-compliance; all staff rulings are final.
9. Loss/Damage Liability for Property
Anime Sekai makes no guarantee of property safety/security. Anime Sekai and Released Parties are not liable for loss or damage to Your personal property. You are solely responsible for its security.
10. Cancellation and Refund Policy
ALL SALES ARE FINAL. ANIME SEKAI HAS A STRICT NO REFUND POLICY. No refunds for any reason (e.g., sales, attendance, cancellation, Your inability to attend). Anime Sekai makes no guarantees regarding attendance or Your financial success. By registering, You acknowledge and agree to the waiver and indemnification terms (Section 1).
11. Event Participation Revocation and Costs
Anime Sekai reserves the right, in its sole discretion, to revoke Your participation (registration, booth, table) at any time, for any reason, without refund. Any costs incurred by You related to Your participation are Your sole responsibility and cannot be charged to Anime Sekai.
12. Code of Conduct and Harassment Policy
A. STRICT NO HARASSMENT POLICY: Anime Sekai enforces zero tolerance for harassment by anyone at the Event.
B. DEFINITION: Harassment includes anything that makes another uncomfortable, or is hostile/unwelcome. Examples include: taking pictures without permission, unwanted physical attention, disrupting events, inappropriate touching, costume destruction, stalking, threats, "bathroom policing," or offensive language.
C. CONSEQUENCES: Violations, in Anime Sekai's sole discretion, result in immediate expulsion without refund and/or a lifetime ban. Serious violations may involve law enforcement.
D. REPORTING: Immediately notify Anime Sekai staff if you experience or witness harassment. Prompt action helps us resolve issues and ensure safety.
13. Policy Updates and Participant Responsibility
Anime Sekai may update these policies in its sole discretion. Any changes will be posted. You are solely responsible for periodically reviewing and staying updated on all rules. Your continued presence constitutes acceptance of any updated policies.
